Republic Act No. 9646, or the Real Estate Service Act of the Philippines (RESA), regulates the practice of real estate service in the country.
Under the law, a real estate broker is a duly registered and licensed professional who may perform activities such as offering, advertising, soliciting, listing, promoting, mediating, and negotiating real estate transactions for compensation.
Real estate salespersons, meanwhile, perform real estate services for and on behalf of a duly licensed real estate broker and are subject to that broker's direct supervision and accountability.
RESA also expressly prohibits unauthorized persons from practicing or offering to practice real estate service, subject to the exemptions provided by law.
The Professional Regulation Commission continues to regulate the profession through the Professional Regulatory Board of Real Estate Service and publishes rules and guidelines concerning real estate service practitioners, including guidelines on the accreditation and supervision of real estate salespersons.
Yet consumers browsing social media may not immediately know the difference between a licensed broker, an accredited salesperson and someone who is simply calling himself or herself an "agent."
